How Does the Texas Civil Litigation Process Work? 

Civil litigation cases vary widely in their individual circumstances, but all plaintiffs must follow some specific procedures while navigating the justice system. Civil litigation in Texas has a few basic phases:

Opening Investigation

During the opening investigation phase, attorneys review the claim to determine whether there is enough evidence to support a case.

Pleadings Phase

During the pleadings phase, legal documents, including the complaint and answer, are filed.

Discovery Phase

In discovery, legal representatives for each side begin deeper investigations and review the evidence presented by the opposing counsel.

Pre-Trial

The pre-trial phase starts with research into whether you have a claim that a judge would hear, including verifying that you are in the right jurisdiction. After filing a complaint, you must notify the other party and allow them to respond.
Discovery is also part of the pre-trial phase. It is the process of obtaining relevant information from the other party. A case may be settled out of court at any time before trial, and courts encourage parties to consider and investigate alternative dispute resolution.

Trial

If a case goes to trial, jury selection will be made first (if it is not waived). A judge or jury will listen to both sides and then make a decision about the case.
